You further agree that you will not modify the grip in any way. Improper installation or modifications to the grip can lead to product malfunction causing serious risk. Risks include but are not limited to product damage, serious physical injury, disability and/or death. PIVOT POINT is not responsible and will not be held liable for any improper installation or modifications done to the grip. YOU EXPRESSLY AND VOLUNTARILY ASSUME THE RISK OF DEATH OR OTHER PERSONAL INJURY SUSTAINED as a result of failing to follow the Installation Instructions or modifying the product. Additionally, you agree to indemnify, defend, and hold PIVOT POINT harmless from any third party claims arising from failure to follow the Installation Instructions or modifications to the PIVOT POINT grip.

Assumption of Risk of Modifying Bat Handle:

By buying, installing, or using this self-install PIVOT POINT grip, you agree to assume the risk for any damage to a bat or personal injury sustained as a result of any modifications you make to a bat. YOU EXPRESSLY AND VOLUNTARILY ASSUME THE RISK OF DEATH OR OTHER PERSONAL INJURY SUSTAINED as a result of bat modifications. Additionally, you agree to indemnify, defend, and hold PIVOT POINT harmless from any third party claims arising from bat modifications.

 

Limitation of Liability

PIVOT POINT's liability is limited to replacement of its products which are returned to it in the specified period of time following PIVOT POINTS Return Policy. In no event shall PIVOT POINT's liability exceed the value of the product(s) sold. In no event shall PIVOT POINT be liable for any direct, indirect, punitive, incidental, special or consequential damages whatsoever arising out of or connected with the use or misuse of any of its products.

 

Inspect Before Each Use

The grip must be inspected before use to ensure it has not been damaged in shipment. If any damage is detected, contact PIVOT POINT GRIPS and DO NOT install the grip.
